Terms of use

Version 2026-10-20 · As of: 20.10.2026 · Nestor 30.2.7 · Provider: [PLATZHALTER: Vor- und Nachname] (“Nestor Plan”), [PLATZHALTER: Straße und Hausnummer], [PLATZHALTER: PLZ und Ort] — hereinafter “we” (full details in the legal notice)

1. What Nestor is — and what it is not

For a plot, Nestor produces feasibility concepts: building volumes, floor plan concepts, key figures, cost and rule estimates as well as plans and models for download. The arrangement of the rooms is proposed by an AI service and checked by Nestor against fixed rules; results are labelled “KI-gestützt erstellt” (created with AI support).

Every result is a feasibility concept — not a building permit submission, not an architect's or engineer's service, not legal advice. The rule check is a preliminary check without warranty. A building application requires planning and review by a person authorised to submit building documents (bauvorlageberechtigte Person) and the decision of the building supervisory authority. Plot, cadastre and market data come from public sources and may be incomplete or out of date.

2. Account

  1. You need an account for every design calculation. You register with an e-mail address and a password and confirm the e-mail address with a six-digit code that we send you. Only then can the account be used.
  2. Nestor is not directed at children and young people. You may only create an account if you are at least 18 years old or act on behalf of a business; you confirm this when you register.
  3. Each person may have only one account. The account is personal and not transferable. Keep your password secret and inform us without delay of any misuse of your account.
  4. When you register, you accept these terms of use; we store the accepted version together with the time.

3. Free pilot

Nestor is free of charge during the pilot phase; you pay nothing, and we sell nothing. Each account can calculate up to 5 designs (pilot quota). You can request further designs informally by e-mail to info@nestorplan.de. There is no entitlement to further designs or to the continuation of the pilot. We may change the scope and conditions of the pilot for the future; results already created remain unaffected. Should Nestor later become subject to a charge, this applies only after a separate agreement with you.

4. Permitted use

You may use Nestor for your own projects and for your clients' projects and use, print and pass on the results for these projects to the parties involved (for example planners, building owners, financiers). The licence notices of the data sources (ALKIS Thüringen, OpenStreetMap, Swiss Dwellings, ResPlan) stay with the results.

5. What is not permitted

If you breach these rules, we may block or terminate your account (section 9).

6. Warranty

The results are a preliminary check without warranty. We strive for correct results, but we do not warrant that a design is approvable, buildable or feasible at the stated costs, nor that the public data adopted are correct and complete. Have every result checked by experts before you make a decision.

7. Liability

  1. Nestor is free of charge during the pilot phase. We are therefore liable — in line with the statutory rule for gratuitous services (§§ 521, 599 BGB) — only for intent and gross negligence.
  2. Our liability for damage arising from injury to life, body or health, under the Product Liability Act (Produkthaftungsgesetz), under an expressly assumed guarantee and for fraudulently concealed defects (§§ 523, 524, 600 BGB) remains unaffected.
  3. These rules also apply to our vicarious agents (Erfüllungsgehilfen).

8. Availability

During the pilot phase Nestor is provided without a commitment to any particular availability. Maintenance, disruptions at third parties (hosting, geodata services, AI service) or further development may restrict the service temporarily. Results are deleted 90 days after they were created; download the files you want to keep in good time.

9. Term, termination and deletion

  1. You can stop using Nestor at any time and delete your account yourself at any time; this deletes the account, all sessions and all runs. You can also request the deletion by e-mail.
  2. We can terminate the pilot and your account by e-mail with two weeks' notice. In the event of a breach of section 2 or 5, we can block or terminate the account with immediate effect.
  3. Unconfirmed accounts are deleted after 7 days. What happens to your data is set out in the privacy notice (German, with a short English summary at the end).

10. Changes to these terms

If we change these terms, we present the new version to you for acceptance before any further use; we store the accepted version together with the time. If you do not accept the new version, you cannot continue to use Nestor and can delete your account; you can download the results created up to then until they are deleted.

11. Applicable law and dispute resolution

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, the mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected. If you are a merchant (Kaufmann), the place of jurisdiction is our place of business. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

12. Final provision

Should a provision be invalid, the remaining provisions remain valid; the statutory provision takes the place of the invalid one.
